Terms of Service
Introduction
These Terms of Service ("Terms") govern your use of Dadroit services and applications, a suite of services provided by Dadroit Co. (the "Dadroit", "Service", "we", us", "our").
Agreement
By using our Services, you agree to be bound by these Terms. If you don’t agree to these Terms, do not use the Services. If you are accessing and using the Services on behalf of a company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms. In that case, "you" and "your" will refer to that company or other legal entity.
Updates
We may modify the Terms at any time, in our sole discretion. If we do so, we’ll let you know either by posting the modified Terms on the Site or through other communications. If you continue to use the Services, you are indicating that you agree to the modified Terms. We may change or discontinue all or any part of the Services, at any time and without notice, at our sole discretion.
Warranty
There is no warranty for the program, to the extent permitted by applicable law. Except when otherwise stated in writing the copyright holders and/or other parties provide the program "As is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the program is with you. Should the program prove defective, you assume the cost of all necessary servicing, repair or correction.
Pricing
Subject to these Terms, the Services are provided to you for free up to certain limits and with limited features. Except for Non-Commercial Use, usage over these limits or access to certain features requires you to purchase a subscription. The number of computers you may use our software on shall not exceed the number of the subscription purchased. If You exceed the limit, we may block the License Key.
"Non-Commercial Use" means use of the Software in an environment not primarily intended for, or directed towards, commercial advantage or monetary compensation.
Payment
When you purchase a Subscription (such purchase, a "Transaction") you expressly authorize us (or our third party payment processor) to charge you for such Transaction. We may ask you to supply additional information relevant to your Transaction, including, without limitation, your credit-card number, the expiration date of your credit card, and your address for billing (such information, "Payment Information"). You represent and warrant that you have the legal right to use all payment method(s) represented by any such Payment Information. When you initiate a Transaction, you authorize us to provide your Payment Information to our third party service providers so we can complete your Transaction and to charge your payment method for the type of Transaction you have selected (plus any applicable taxes and other charges). You may need to provide additional information to verify your identity before completing your Transaction (such information is included within the definition of Payment Information).
Recurring Payments
If you purchase a Subscription, you will be charged the then-applicable Subscription fee ("Subscription Fee") at the beginning of your Subscription and each month, quarter or year thereafter, depending on the term of your Subscription, at the then-current rate. Please note that our Subscription Fees are subject to change, although we will notify you before we effect any change in Subscription Fees.
By agreeing to these Terms and purchasing a Subscription, you acknowledge that your Subscription has recurring payment features and you accept responsibility for all recurring payment obligations prior to cancellation of your Subscription by you or us. We (or our third party payment processor) will automatically charge you in accordance with term of your Subscription (e.g., each month, quarter or year), on the calendar day corresponding to the commencement of your Subscription, using the Payment Information you have provided.
Cancelling Subscriptions
You may cancel your Subscription at any time but please note that such cancellation will be effective at the end of the then-current Subscription period. You will not receive a refund of any portion of the subscription fee paid for the then current subscription period at the time of cancellation. To cancel, you can either email us and follow any instructions, if any, we provide to you in response to your cancellation request, or initiate a cancellation through your Account settings within the Services. You will be responsible for all Subscription Fees (plus any applicable taxes and other charges) incurred for the then current Subscription period.
Copyright
All right, title, and interest in and to the service will remain the exclusive property of Dadroit, and its licensors. You may not delete or alter any disclaimers, warnings, copyright or other proprietary notices accompanying the service. You shall not acquire any ownership to the service as a result of your purchase or use of it.
Nothing in the Agreement gives You the right to use Dadroit name or any of Dadroit trademarks, logos, domain names and other distinctive brand features.
Prohibited Usage
You are granted a non-exclusive, non-transferable, revocable license to access and use our service strictly in accordance with these terms of conditions. As a condition of your use of the service, you warrant to us that you will not use the service for any purpose that is unlawful or prohibited by this document. You may not use the site in any manner which could damage, disable, overburden, or impair the usage or interfere with any other party's use of the service. You must not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the service. You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the service. Our website or applications cannot be used for resale. Your use of the service does not entitle you to make any unauthorized use of any protected content, and in particular, you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use and will make no other use of the content without the express written permission of us and other copyright owners. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, expressed or implied, to the intellectual property of us except as explicitly authorized by us.
Publicity
You agree that we may identify you or your company and use your company’s logo and trademarks (collectively, the "Marks") on the Site and in marketing materials to identify you or your company as a user of the Services, and you hereby grant us a non-exclusive, royalty-free license to do so on our Site or in any media now or later developed in connection with any marketing, promotion or advertising or the Services. If you do not want to allow us the right to use your Marks or identify you or your company you may opt out such marketing requests by emailing us.
Open Source License
All of the published source codes are dual-licensed, Under "GPL v3 or later" or a commercial license for use in non-GPL software.
Termination
We may terminate your access to and use of the Services, at our sole discretion, at any time and without notice or liability to you, provided that, if you have paid for a Subscription and the termination is not due to your breach of this Agreement, we will refund you any prepaid fees for the period of your Subscription that extends beyond the effective date of such termination. You may cancel your Account at any time by sending an email to us.
Privacy Policy
Introduction
This Privacy Statement ("Privacy Policy") informs you about the type of personal data that is collected and received through Dadroit services and applications, a suite of services provided by Dadroit Co. (the "Dadroit", "Service", "we", us", "our"), and about how we use, share, retain and protect such personal data.
Terms of Service
This Privacy Policy forms part of our Terms of Service, which describes the terms under which you use our Services. This Privacy Policy should therefore be read in conjunction with those terms.
Scope
This Privacy Policy applies to personal information processed by us in our service including websites and applications. This Privacy Policy does not apply to any third-party websites, services or applications, even if they are accessible through our Services. Please note that if you use the Services on behalf of an organization (e.g., your employer), our use of your personal information may be governed by the agreement we have with that organization. Data
Personal data means any information relating to an identified or identifiable natural person. We only process personal data of our users if this is necessary to provide a functional website as well as our contents and services. When you create an Account, we will collect personal information, such as your name, email address, personal website, and picture.
We may sell services or merchandise through our Services. When you make purchases through the Services, we may process your payments through a third-party application and payment processing services such as Stripe. The third-party application may collect certain financial information from you to process a payment on behalf of us, including your name, email address, address, payment card information, and other billing information. We do not store or receive your payment information, but it may store and receive information associated with your payment information (e.g., your billing details).
We collect personal information from you such as email address, phone number, or mailing address when you request information about our Services, register for our newsletter, or otherwise communicate with us.
We may collect certain information automatically when you use the Services. This information may include your Internet protocol (IP) address, user settings, and other unique identifiers, details about your browser, operating system or device, location information (including inferred location based off of your IP address), Internet service provider, pages that you visit before, during and after using the Services, information about the links you click, and information about how you interact with and use the Services.
We may also use Google Analytics and other service providers to collect and process analytics information on our Services. However, due the inherent open nature of the Internet, we cannot guarantee that communications between you and us or the personal information stored is absolutely secure.
